She said he could be sent to Algeria or Syria, where he was born in a refugee camp. If he is deported, his life will be in grave danger. And here’s what you may not know, because so much of the focus is on the Trump administration: the judge who issued that ruling, Jamee E. Comans, was actually appointed in 2021 under President Joe Biden.

Who Is Mahmoud Khalil?
Mahmoud Khalil is not a criminal. He’s a husband to a U.S. citizen, the father of a five-month-old U.S.-born son, and a recent Columbia graduate student. He was arrested in March during Trump’s nationwide crackdown on pro-Palestinian activism.
The government accused him of “pro-Hamas activity” — a complete fabrication for which they produced no evidence. His lawyers argue that he’s being persecuted for exercising his First Amendment rights: for protesting Israel’s genocide in Gaza and speaking out against U.S. complicity. And that’s all this is. Nothing about this man is dangerous and it’s ridiculous to suggest as much.
Khalil himself has called his proceedings a “kangaroo court,” saying it’s retaliation for his beliefs.
The Judge Behind the Ruling
Judge Jamee E. Comans is the one who ordered Khalil deported. And here’s what’s crucial:
She was appointed in October 2021 under the Biden administration by Attorney General Merrick Garland.
Before that, she worked nearly a decade as an ICE prosecutor, first as Assistant Chief Counsel in Memphis, then as Deputy Chief Counsel in Louisiana.
Her career was built inside the very enforcement agency now prosecuting Khalil.
So while the headlines frame Khalil as Trump’s target — and that’s true politically — the machinery being used to exile him is staffed and legitimized by Biden’s DOJ.
The Bipartisan Machinery of Repression
This is the part people need to understand. Trump supplies the rhetoric, the crackdown, the criminalization of dissent. But the judges and courts that carry it out are bipartisan.
Democrats love to say they defend immigrants and human rights. But here is a Biden-appointed judge, with an ICE enforcement background, preparing to send a Palestinian activist into mortal danger.
It is proof that:
Immigration courts are not neutral. They are run by the Department of Justice, not independent from politics.
The system is structurally pro-enforcement. Judges are often drawn from ICE itself.
Both parties maintain the machine. Trump presses the button. Biden staffs the gears.
This is why Khalil’s case matters beyond one man. It shows that whether it’s Trump or Biden in office, the system is designed to silence Palestinian voices and punish dissent.

What Happens Next?
Khalil’s lawyers will appeal the ruling. But their odds aren’t good. His appeal will go to one of the most conservative federal circuits in the country.
At the same time, a federal judge in New Jersey has issued an order blocking Khalil’s deportation while his civil rights lawsuit plays out. That suit seeks $20 million in damages, claiming false imprisonment and political retaliation. For now, that order is the only real shield keeping him in the United States.
But if the shield fails, Judge Comans has already ruled: deport him to Algeria or Syria. His lawyers argue either would be a death sentence.
Why This Is So Dangerous
Family, think about this. Mahmoud Khalil was born stateless in a Palestinian refugee camp in Syria. His family was displaced from Tiberias during the Nakba. He fled Assad’s Syria after protesting the regime in 2013. And now, in 2025, the United States is preparing to deport him back into mortal danger — because he dared to protest genocide on a college campus.
This is what empire does. It punishes those who speak the truth. It rips apart families. It takes a man with a wife and infant son and tells him: your life is disposable.
Why This Matters for All of Us
This isn’t just about Mahmoud Khalil. It’s about precedent. If the government can deport him for his beliefs, who’s next? If they can use immigration courts to punish Palestinian activism, they can use them to silence anyone.
This is the bipartisan truth: Trump calls the shots, but Biden’s appointees carry them out. So much of the machinery of inequity in America is bi-partisan to the bone and anyone saying otherwise is lying.
